Welcome to Lesstopy Global, operated by Custics Singapore Pte. Ltd. with operations based in the Republic of Korea (โ€œwe,โ€ โ€œus,โ€ or โ€œourโ€). These Terms of Service (โ€œTermsโ€) apply to our Shopify-hosted website and to all products, goods, or services you purchase through the Site (collectively, the โ€œServicesโ€).

BY USING THE SERVICES, YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT. PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN A CLASS ACTION WAIVER, A BINDING ARBITRATION CLAUSE, AND STRICT LIMITATIONS ON YOUR LIABILITY AND TIME TO BRING CLAIMS.

If you do not agree to these Terms, you must immediately cease using our Services.

1. Cross-Border Shipping, Customs, and Import Disclaimer

Lesstopy Global ships products internationally from South Korea. By purchasing our products, you acknowledge that you are the importer of record.

  • Customs and Delays: We are not responsible or liable for any delays, seizures, or confiscations made by your local customs authorities.
  • Duties and Taxes: While we may offer DDP (Delivered Duty Paid) for certain regions, any unforeseeable local import duties, taxes, or clearance fees remain the sole responsibility of the customer.
  • No Refunds for Abandonment: If a package is returned, destroyed, or abandoned due to your failure to pay required local customs fees or provide necessary clearance information, NO REFUNDS will be issued.

2. Chargeback Abuse and Fraud Penalty

We strictly monitor and penalize fraudulent payment disputes. If you initiate a chargeback or payment dispute with your credit card company or PayPal for a validly delivered order, or make false claims of non-receipt:

  • Dispute Fee: You agree to be liable for a $50 USD Administrative Dispute Fee per incident to cover our investigative and operational costs.
  • Collections and Banning: We reserve the absolute right to ban your account, blacklist your IP, and forward your details (including order history, communications, and tracking data) to third-party collection agencies and global fraud-prevention databases to recover the disputed funds and fees.

3. Prohibition on "Testers" and Malicious Use

You are strictly prohibited from using our Services if you are a โ€œTester.โ€ A Tester is defined as any individual, agent, or legal representative whose primary purpose of accessing the Services is to identify technical, accessibility, or legal vulnerabilities in order to initiate legal claims, demand letters, or lawsuits against us.

4. Artificial Intelligence (AI) Training Ban

You are strictly prohibited from scraping, copying, or using any information, text, reviews, or materials derived from our Site for the purposes of training artificial intelligence (AI), machine learning models, or large language models (LLMs).

5. Disclaimer of Warranties

YOUR USE OF THE SERVICES AND PRODUCTS IS AT YOUR SOLE RISK. ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6. Strict Limitation on Liability (EU-Compliant Cap)

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LESSTOPY GLOBAL, ITS AFFILIATES, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.

  • Maximum Liability Cap: In no event shall our total collective liability to you for any claims exceed the actual amount you paid for the specific product in dispute, or Fifty US Dollars ($50.00), whichever is less.
  • EU/EEA Consumer Exception: If you reside in a jurisdiction (such as the European Economic Area) that strictly prohibits the limitation of liability for intentional misconduct, gross negligence, or limits the restriction of statutory consumer rights, the above limitations shall apply to you only to the absolute minimum extent permitted by your local mandatory laws.

7. Indemnification

You agree to fully defend, indemnify, and hold harmless Lesstopy Global against any claims, damages, costs, or attorney's fees arising from your breach of these Terms, your violation of any laws, or any false information provided by you.

8. Governing Law and Exclusive Jurisdiction (South Korea)

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

9. Binding Arbitration and Waiver of Class Actions

  • Mandatory Individual Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be finally resolved by binding confidential arbitration administered by the Korean Commercial Arbitration Board (KCAB) in Seoul, Republic of Korea, in accordance with the International Arbitration Rules of the KCAB. The language of the arbitration shall be English.
  • Class Action Waiver: YOU AND LESSTOPY GLOBAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

10. Severely Restricted Time Bar (Statute of Limitations)

YOU AGREE THAT ANY CAUSE OF ACTION OR CLAIM ARISING OUT OF OR RELATED TO THE SERVICES MUST BE COMMENCED WITHIN SIX (6) MONTHS AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Note: If you are a consumer in the EU/EEA where such a restriction is expressly voided by mandatory local consumer protection laws, this time bar shall be extended only to the shortest statutory limitation period required by your local law.

11. Entire Agreement and Changes

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us. We reserve the absolute right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your binding acceptance of the new Terms.
